FCC Proposes Disclosure Requirement for AI-Generated Content in Political Ads

The Federal Communications Commission (FCC) has proposed a rule requiring the disclosure of AI-generated content in political advertisements, though not outright banning such content. Chairwoman Jessica Rosenworcel announced the proposal on Wednesday, emphasizing the need for transparency in political ads to inform consumers when AI tools are being utilized. This proposed rule would mandate both candidate and issue ads to include on-air and filed disclosures indicating the use of AI-generated content. The requirement would apply to cable operators, satellite TV, and radio providers, but not to streaming platforms like YouTube, over which the FCC lacks regulatory authority.

The proposal marks the initial public step in creating a new regulation, with the FCC seeking comments on the necessity and definition of AI-generated content in political ads. The FCC document highlights the public interest in protecting against false, misleading, or deceptive programming and promoting an informed public. If adopted, this regulation could help deter low-effort attempts at using AI in deceptive ways and provide a basis for addressing malicious activities, such as those conducted by companies behind fake AI-generated political calls.
