California Enacts AI Protections for Actors and Other Performers

California Governor Gavin Newsom signed two bills into law to protect performers from unauthorized use of their digital likenesses, particularly in the face of rising concerns over artificial intelligence. These bills offer legal protections for performers' digital images and voices, both during their lifetimes and after their deaths, aiming to safeguard artists from exploitation.

Key Points

  • Bill AB 2602:

    • Prevents performers from being bound to contracts that allow the use of their digital voices or images, especially for AI training or replacement work.

    • Applies to both past and future contracts, requiring contract holders to notify the other party by February 1st of any invalid clauses.

  • Bill AB 1836:

    • Protects performers' posthumous rights, allowing rights holders to sue for unauthorized use of a deceased performer’s digital likeness.

    • Rights holders are entitled to at least $10,000 or actual damages, whichever is greater.

  • SAG-AFTRA Support:

    • The union, which represents about 160,000 media professionals, has strongly supported these bills to address growing concerns about AI replacing human labor.

The new laws are a significant step toward protecting performers from exploitation particularly with the rapid advancement of AI. Many in the entertainment industry are also awaiting Newsom’s decision on SB 1047, which would require AI developers to adhere to safety guidelines.

Snap Expands AI Tools for Creators

At the Snap Partner Summit, Snap, the parent company of Snapchat, introduced a suite of new AI tools aimed at enhancing creator capabilities. Key updates include Easy Lens, a feature that allows users to generate augmented reality (AR) Lenses from plain-English descriptions, and Body Morph, which creates 3D characters from text or images. Snap also plans to add more generative AI features to its platform. CEO Evan Spiegel emphasized the transformative impact of AI, which has driven significant growth in Snap's creator base, despite challenges in the advertising market.
